Advertiser Terms

These terms are between [Four Swags Pty Ltd, ABN ___] ("Four Swags", "we") and the business named in the order ("you"). The order is the package, price, start date and billing you choose when you accept a proposal online or sign an order form. The order and these terms together are the agreement. If they differ, the order applies.

What we provide

1. Placements. We show your business on Four Swags as described in your package, from the start date in your order. We decide the exact layout, position and design, and may improve them over time without reducing what your package includes.
2. Labelled. Your placements are labelled as a partner or sponsored listing.
3. No guaranteed results. We don't promise a number of views, clicks, enquiries or bookings.
4. Reports. We send a monthly report of views and clicks. Clicks are counted by our system, which leaves out repeated clicks from the same person in a short time and clicks from automated programs.
5. If something goes wrong. If your placements don't run for more than [2] days in a row because of a fault on our side, we credit that time against your next invoice.

Fees and payment

1. Fees. You pay the fees in your order, in Australian dollars (plus GST), and we send a tax invoice.
2. Monthly packages are billed monthly in advance, from the start date (or the end of any free founding period). Annual packages are paid up front. Pay per click is invoiced monthly in arrears for that month's clicks, up to the monthly limit in your order.
3. How you pay. When you accept, you authorise us (through our payment provider, Stripe) to charge your card or debit your bank account for each amount when it's due. Direct debits are also covered by Stripe's direct debit request service agreement, which you accept at the same time.
4. Due date. Invoices are due within [7] days. If a payment fails, we'll tell you and try again.
5. Late payment. If an amount is more than [14] days overdue, we may pause your placements until it's paid, after telling you. We may charge interest on overdue amounts at [the rate set under the Penalty Interest Rates Act 1983 (Vic)], and the reasonable costs of recovering them.
6. Founding prices. If your order has a founding price or free period, it's held for the time stated in the order. After that, the standard price applies, with at least [30] days' notice of any increase.
7. Price changes. We can change prices with at least [30] days' notice by email. A change never applies during a period you've already paid for, or before the end of a locked-in founding price.

Term and cancelling

1. Monthly packages continue month to month. Either of us can cancel with [30] days' notice by email. Fees for the notice period are payable.
2. Annual packages run for 12 months and are not refundable, except as the law requires or if we end the agreement for no reason of yours (then we refund the unused months).
3. Pay per click can be stopped by either of us at any time by email. Clicks up to then are invoiced.
4. Ending for a breach. Either of us can end the agreement by email if the other seriously breaks it and doesn't fix it within 14 days of being asked.
5. When it ends, we remove your placements, and any fees owed up to the end date stay payable.

Your ads and offers

1. Accurate. Everything you give us for your ads (names, photos, prices, offers and links) must be true, up to date and yours to use, and must comply with the Australian Consumer Law and any licence or permit your business needs.
2. Your offers. Any discount or offer you advertise is between you and the customer. You must honour it as advertised.
3. Our review. We may decline or remove an ad that breaks these terms, is misleading, or isn't suitable for a family camping site, and will tell you why. If we remove an ad for that reason, the fees for the period still apply unless you supply a suitable replacement within [7] days.
4. Permission to show it. You give us permission to display, resize and crop your ad content on Four Swags and in Four Swags' own promotions of your placement, for as long as the agreement runs.

Liability

1. Nothing in these terms excludes rights you have under the Australian Consumer Law that can't be excluded.
2. Otherwise, to the extent the law allows, our total liability to you under this agreement is limited to the fees you paid us in the [3] months before the claim, and neither of us is liable for the other's indirect loss or lost profits.
3. You're responsible for claims made against us because of your ad content or your offers, to the extent they were caused by you.

General

• Privacy. We don't give you renters' personal information. Reports are totals, not individuals.
• Notices are given by email to the addresses in the order.
• Changes to these terms. We may update these terms with at least [30] days' notice by email. If a change is significantly worse for you, you can cancel before it starts without paying the notice period.
• Law. These terms are governed by the law of [Victoria]. We'll try to resolve any dispute by talking first, then mediation, before going to court.
