Owner Listing Agreement
Version 2026-10-draft
This agreement is between you (the owner) and [Four Swags Pty Ltd, ABN ___]. You accept it before your first listing goes live.
- What we do. We run an online marketplace that connects you with people who want to hire your gear. We are not a party to the hire itself; the hire contract is between you and the renter.
- Eligibility. You must be 18 or over, live in Australia, and own the item or have the owner's permission to hire it out. We may check your identity and bank details through our payment provider before paying you.
- Your listings. Your listing must describe the item truthfully, including brand, model, age, condition, any faults and what's included. Photos must be of the actual item. You set your own prices and availability. Our suggested prices are a guide only. Your first listing is checked by us before it goes live.
- Condition and safety. You must keep listed items clean, complete, safe and in good working order. Gas appliances and cylinders must be within their test date. Electrical items, batteries and solar gear must be undamaged. You must not list recalled, unsafe or prohibited items.
- Accepting bookings. You agree to respond to booking requests within [24] hours. Once a booking is confirmed, you must make the item available at the agreed time and place.
- Handover. At pick-up and return, you and the renter go through the in-app checklist together (including showing the renter how to set up, use and pack down the item), take photos, and both sign. The signed checklist and photos are the shared record of the item's condition. You can't mark an item picked up or returned until both have signed.
- Fees. We deduct a commission of 10% of the hire price plus GST from each booking. GST (10%) is added to the commission, and your payout statement is a tax invoice for it. We'll give you at least [30] days' notice of any fee change, and changes don't affect bookings already confirmed.
- Payouts. We pay you the hire price less our commission and its GST about [24 hours] after a completed check-out, to your nominated bank account, through our payment provider.
- Cancellations by you. If you cancel a confirmed booking, the renter gets a full refund. Repeated cancellations may lead to a fee of [$__], lower search placement, or removal.
- Damage, loss and theft. Claims must be lodged at return or within [24] hours of it, with check-out photos. The renter pays up to their damage excess from their bond, and Four Swags pays you for covered damage above that under the damage protection terms (or the vehicle insurer does, for caravans and campers where insurer cover applies), up to the item's [market value]. Fair wear and tear is not damage. Money awarded from a bond is paid to you without commission.
- Your insurance. You're responsible for your own insurance on the item. Some personal policies don't cover items hired out, so you should check yours. Our damage protection is described in the protection terms and is not a substitute for your own cover unless those terms say so.
- Tax. You're responsible for any tax on your earnings. We are required to report your hire income to the ATO under the Sharing Economy Reporting Regime, and you agree to give us the details needed for that.
- Conduct. You must not ask renters to pay or communicate outside Four Swags to avoid fees, or discriminate against renters.
- Ending the agreement. You can close your account at any time after completing any confirmed bookings. We may suspend or remove listings that break this agreement or put people at risk, and will tell you why.
- Liability. Nothing in this agreement excludes rights you have under the Australian Consumer Law. Otherwise, our total liability to you is limited to the fees we earned from your bookings in the [12] months before the claim.
- Disputes and law. Disputes go first to our resolution team, then to mediation, before any court action. This agreement is governed by the law of [Victoria].
